Overview

These Terms and Conditions (“Terms”) outline the rules and regulations for the use of the INB Push platform, owned by INB Web Solution (collectively referred to as “the Company,” “we,” “our,” or “us”).

By registering for, accessing, or using https://inbpush.in, you agree to be bound by these Terms in full. If you disagree with any part of these Terms, you must not use our services.

Part A: General Terms

  1. Acceptance of Terms

    Your access to and use of INB Push signifies your full acceptance of these Terms. We reserve the right to update these Terms at any time. Continued use of the service after changes implies acceptance of the revised Terms.

  2. "Powered By" Branding and Watermark

    As INB Push provides a free service, you agree not to remove, obscure, hide via CSS, or alter any “Powered by INB Push” notices, logos, or brand identifiers located in the notification prompts, bells, or widgets. Attempting to bypass this branding is a violation of these Terms and may result in immediate account termination.

  3. Intellectual Property

    All software, code, designs, and intellectual property related to INB Push remain the property of the Company. You are granted a limited, revocable, non-exclusive license to use the service for your website’s engagement needs. You may not reverse engineer, decompile, or attempt to derive the source code of the service.

  4. Third-Party Dependency

    Our services rely on Google Firebase Cloud Messaging (FCM) and modern browser standards (Chrome, Firefox, Edge, etc.) to deliver notifications. We are not responsible for delivery failures caused by:

    • Google FCM downtime or policy changes.

    • Browser updates that change push notification standards.

    • End-user network issues.

  5. Prohibited Content

    You are strictly prohibited from using INB Push to send notifications that contain:

    • Pornography or sexually explicit content.

    • Hate speech, violence, or illegal activities.

    • Malware, viruses, or phishing links.

    • Scams or fraudulent schemes.

    Violation of this policy will result in an immediate, permanent ban without notice.

  6. Limitation of Liability

    In no event shall the Company be liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use our service. Our service is provided "as is" and "as available" without any warranties, express or implied.

  7. Indemnification

    You agree to indemnify and hold harmless INB Push and its owners from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or the content of the notifications you send.

  8. Disclaimer of Warranties

    To the fullest extent permissible under applicable law, INB Push expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. INB Push makes no representations or guarantees that its products or services will be uninterrupted, secure, accurate, or error-free. All use of the services is undertaken solely at the user’s own risk.

  9. Force Majeure

    INB Push shall not be held responsible for any delay or failure to fulfill its obligations under these Terms if such delay or failure results from causes outside our reasonable control. This includes, but is not limited to, severe weather conditions, earthquakes, fires, floods, pandemics, strikes or labor disputes, war, terrorism, government actions, internet service provider failures, or Denial of Service (DoS) attacks. In such events, our obligations will be suspended for the duration of the disruption.

  10. Governing Law and Dispute Resolution

    These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or in connection with these Terms shall be referred to and finally resolved by binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The seat of arbitration shall be the state in which the Company is incorporated. Each party shall bear its own costs and expenses arising from the arbitration proceedings.

  11. Entire Agreement

    These Terms and Conditions, together with all documents expressly incorporated by reference, including the Privacy Policy, constitute the entire agreement between the parties and supersede all prior or contemporaneous agreements, negotiations, or understandings, whether written or oral. INB Push reserves the right to amend these Terms at any time, and continued use of the services following such amendments shall constitute acceptance of the modified Terms.

Part B: Managed Push Notification Service (Free Plan)

The following terms apply specifically to your use of our Managed Push Service.

  1. Free Plan Usage & Monetization

    You acknowledge that INB Push offers this service for free. In exchange for the free use of our technology and server resources:

    • Advertisements: We reserve the right to send a limited number of advertisements (e.g., up to 2 per day) to the subscribers collected via our platform on your website. These ads help cover our server costs.

    • Data Rights: You grant us the right to use anonymized subscriber data to target these advertisements (e.g., based on geography).

  2. Domain Activation & Inactivity

    • Activation: Once you add a domain to INB Push, you must integrate the required script and verify the domain within 30 days. Unverified domains may be removed to save system resources.

    • Inactivity: Free plan accounts or domains with low volume (under 10,000 subscribers) that show no activity (no logins or campaigns sent) for a period of 90 days may be considered dormant and are subject to deletion.

  3. Subscriber Cleanup

    To maintain system efficiency and data accuracy, we periodically remove invalid subscriber tokens (users who have blocked notifications or uninstalled browsers) from your list. This is an automated process.

  4. Service Modifications

    We reserve the right to modify the features of the Free Plan at any time. This includes, but is not limited to, placing caps on the number of subscribers, the number of campaigns per day, or the speed of delivery.

  5. Termination

    We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination:

    • Your right to use the Service will cease immediately.

    • You will lose access to your subscriber list.
